Terms of Service
FlagRisk is not an emergency service
FlagRisk does not send help. We do not dispatch police, ambulances, fire services, or private security, and we have no arrangement with any of them. When you use the panic hold, we notify people in your trusted circle. Nobody else is alerted.
If you are in danger, call the emergency services. In Nigeria the national emergency number is 112. Do that first. Use FlagRisk in addition, never instead.
FlagRisk depends on your phone, your battery, your network, and services we do not control. It can fail. Do not rely on it as your only means of getting help.
1.Who we are and what these terms cover
FlagRisk is operated by FlagRisk Technologies Limited, a company registered in Nigeria with registration number RC 9690636 and its registered office at 325 Enugu Road, FCDA Quarters, Bwari, Abuja, Nigeria. In these terms, "we", "us", and "our" mean that company, and "you" means the person using FlagRisk.
These terms apply to the FlagRisk mobile application, the FlagRisk website, the FlagRisk account on WhatsApp, and any related service we provide, together the "Service".
By creating an account or using the Service you agree to these terms. If you do not agree, do not use the Service.
Our Privacy Policy and our Community Guidelines form part of these terms.
2.What FlagRisk does, and what it does not do
The Service allows you to alert a group of people you choose, to see and to submit reports of safety concerns in an area, and to declare a journey or a period of time so that your silence during that journey or period raises an alert. That is the whole of what the Service does.
We are an information and notification service. We do not respond to incidents, we do not verify that help has arrived, and we do not monitor your account or your location for you in real time.
We do not guarantee that any alert will be sent, delivered, received, read, or acted upon. Delivery depends on your device, your battery, your data connection, mobile network coverage, the devices and settings of the people you have chosen, and third party services which we do not control.
We do not guarantee that any information shown in the Service is accurate, complete, current, or suitable for any decision you make. Information on safety concerns is described in clause 6.
You remain responsible for your own safety and for the decisions you take. The Service is one input among many and is not a substitute for your own judgement or for the emergency services.
3.Eligibility and your account
You must be at least 18 years old to use the Service.
You must register with a valid mobile telephone number and verify that number. You must give accurate information and keep that information up to date.
Your account is personal to you. You are responsible for keeping your credentials secure and for everything done through your account. Tell us immediately if you believe someone else has access to your account.
You may not create an account on behalf of another person without their knowledge and consent, and you may not use the Service to monitor a person without their knowledge.
A person who writes to the FlagRisk account on WhatsApp and shares their mobile number opens a FlagRisk account identified by that number. The same account serves the application.
4.Your trusted circle
You choose who is in your trusted circle. We do not select, vet, train, or supervise those people, and we do not know whether they are able or willing to help you.
Before you add a person, you must have their consent to share your location and alerts with them. By adding a person you confirm that you have that consent.
A person in your circle receives your alerts and, where the feature is active, your live location. They may see where you are and where you have been during an alert or a declared journey.
You are responsible for keeping your circle current. If a relationship changes, remove the person. We cannot know that a person is no longer to receive your information.
We are not responsible for what a person in your circle does or fails to do, including failing to respond, responding late, or misusing information you have chosen to share with them.
A person you invite on WhatsApp joins your trusted circle only by accepting the invitation from their own mobile number. That person receives alerts on WhatsApp only while they have chosen to receive alerts there, and may stop those alerts at any time by sending STOP ALERTS to the FlagRisk account on WhatsApp.
5.Panic alerts and Trip Watch
The panic hold sends a silent notification to your trusted circle with your location. The panic hold makes no sound on your device and does not contact the emergency services.
The distance over which a panic alert reaches the members of your trusted circle depends on your plan. A member who is outside that distance when the alert is raised is not notified. The reach of each plan is shown in the Service.
Trip Watch allows you to declare a journey. If you do not check in as expected, we notify the people you chose to watch that journey. Trip Watch relies on your phone being able to communicate with us. If your phone is switched off, destroyed, out of coverage, or out of battery, we may be unable to detect anything at all beyond your last known position.
You must not raise a false alert. A false alert wastes the attention of people who care about you, and repeated false alerts may result in suspension.
We may send you messages by text, push notification, WhatsApp, or electronic mail in connection with these features. Message and data charges from your network may apply.
On WhatsApp you raise a panic alert by sending a private word that you have chosen, on its own, to the FlagRisk account. Sending a word is an action that a person beside you can see. If the alert goes out, the reply in the chat is the single word Noted. Any other reply means that the alert did not go out.
A panic alert raised on WhatsApp carries one position, being the last current location you sent in the chat that we still hold. Where we hold no such position, the alert carries no position and is sent to the members of your trusted circle whom you have chosen to receive panic alerts without regard to distance.
A timed watch on WhatsApp covers a period that you choose. If you do not confirm that you are safe before the period ends, we ask you in the chat. If you still do not confirm, we notify the members of your trusted circle whom you have chosen to receive panic alerts. A timed watch is part of Trip Watch and is available on the plans that include Trip Watch.
A panic alert is delivered on WhatsApp on every plan. Other notices are delivered on WhatsApp according to the plan of the person the notice concerns, as shown in the Service.
Delivery on WhatsApp depends on WhatsApp, which is operated by Meta Platforms and which we do not control, and is subject to the limits WhatsApp places on the messages a business may send.
6.Safety concerns and the map
The map of safety concerns is built from reports submitted by other users and from publicly reported incidents drawn from news sources. The map is not an official record and is not verified by any authority.
Reports may be inaccurate, incomplete, exaggerated, out of date, mislocated, duplicated, or false. Some reports are placed at the centre of an administrative area rather than at a precise point, so a marker does not necessarily show where something happened.
A risk score is a calculated estimate produced from the information available to us. A risk score is not a prediction, not a guarantee of safety, and not advice.
An area with no reports is not a safe area. It may simply be an area where nobody has reported anything.
Where we publish information drawn from a news source, we attribute that information to the source. We do not adopt or endorse the content of any such report.
You must not make a decision that affects the safety of yourself or another person on the basis of the map alone.
An answer about an area given on WhatsApp is produced from the same information as the map and is subject to this clause.
7.Content you submit
You are responsible for everything you submit, including reports, descriptions, photographs, and video.
You must not submit anything which is false, misleading, defamatory, abusive, obscene, discriminatory, unlawful, or which infringes the rights of another person. You must not submit a report in order to harm the reputation of a person, a business, or a place.
You must not submit content which identifies a person as a victim or a suspect, or which shows a person in a way that would put them in danger, unless you have their consent.
You keep ownership of what you submit. You grant us a worldwide, non-exclusive, royalty-free, transferable, and sub-licensable licence to host, store, reproduce, adapt, publish, and display that content for the purposes of operating and improving the Service, and to use that content in aggregated and de-identified form.
We may review, moderate, edit the placement of, suppress, or remove any content, and we may suspend or close an account, in accordance with our Community Guidelines. We are not obliged to review content before that content appears.
Where we remove content or restrict an account, you may ask us to review that decision using the process in our Community Guidelines.
A report made on WhatsApp is accepted only from the place where you are, by sending your current location.
8.Location and personal data
The Service requires access to your location. If you withdraw that permission, core features will not work.
We handle personal data in accordance with our Privacy Policy and the Nigeria Data Protection Act 2023.
We publish and analyse information on safety concerns in aggregate form. We do not sell, publish, or make available to any customer any information that identifies you or any other user.
We may disclose information where we are required to do so by law or by a competent authority. Our approach to such requests is set out in our Privacy Policy.
On WhatsApp we hold your location only when you send your current location in the chat. We use a position to decide who is within reach of an alert for seventy-two hours.
9.Plans, payment, and cancellation
Core safety features are free. Paid plans and add-on services provide additional coverage, history, and features, at the prices shown in the Service.
Paid plans renew automatically each month or each year until cancelled. We take payment through our payment provider at the start of each period.
You may cancel at any time in the Service. Cancellation takes effect at the end of the period you have already paid for, and you keep the benefit of the plan until then.
Payments already made are not refundable except where the law requires a refund or where we have failed to provide a paid feature for a material period, in which case we will refund a fair proportion.
We may change our prices. We will give you not less than thirty days notice before a change takes effect for you, and you may cancel before that date.
If a payment fails we may suspend the paid features of your account. Free features continue.
Nothing in this clause affects your rights under the Federal Competition and Consumer Protection Act 2018.
10.Acceptable use
You must not:
- use the Service to stalk, harass, intimidate, monitor, or locate any person without their knowledge and consent;
- submit false reports, or submit reports in coordination with others in order to distort the map;
- attempt to identify any person from information shown in the Service;
- scrape, extract, copy, or resell any part of the Service or its data;
- interfere with the Service, attempt to gain unauthorised access to the Service, or test its security without our written permission;
- use the Service for any unlawful purpose, or in a way that could bring the Service into disrepute; or
- use the Service to build or train a competing product.
11.Availability and changes
We aim to keep the Service available at all times, but we do not guarantee that the Service will be uninterrupted or error free. We may suspend the Service for maintenance, and we will try to give notice where we reasonably can.
We may change, add to, or withdraw features. Where a change materially reduces a paid feature you rely on, we will tell you before the change takes effect and you may cancel.
We may change these terms. We will publish the revised terms and, where the change is material, tell you before the change takes effect. Continuing to use the Service after that date means you accept the revised terms.
12.Suspension and closure
We may suspend or close your account, with notice where practicable, if you breach these terms or our Community Guidelines, if we are required to do so by law, or if we reasonably believe your use is putting another person in danger.
You may close your account at any time in the Service. A person who uses FlagRisk only on WhatsApp closes their account by writing to the address in clause 19. Closing your account ends your paid plan at the end of the period you have paid for.
On closure we retain and delete data in accordance with our Privacy Policy.
13.Our intellectual property
The Service, including its software, design, brand, and the compiled data on safety concerns, belongs to us or to our licensors. Nothing in these terms transfers any right in the Service to you.
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own personal purposes in accordance with these terms.
You must not use the FlagRisk name or logo without our written permission.
14.Disclaimers
The Service is provided as is and as available. To the fullest extent permitted by law, we exclude all warranties, conditions, and representations which are not expressly set out in these terms, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
We do not warrant that the Service will prevent, detect, reduce, or provide warning of any harm, crime, accident, or emergency.
We are not responsible for the acts or omissions of any other user, of any person in your trusted circle, of any emergency service, of any mobile network operator, or of any other third party.
15.Our liability to you
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot be limited or excluded under Nigerian law.
Subject to clause 15.1, we are not liable for:
- any failure of an alert to be sent, delivered, or received;
- any act, omission, delay, or failure to respond by a person in your trusted circle or by any emergency service;
- any decision you or another person makes in reliance on information in the Service;
- any inaccuracy in a report submitted by another user or drawn from a news source;
- any loss arising from your device, your battery, your network, or any third party service; or
- any indirect or consequential loss, or any loss of profit, revenue, business, opportunity, or data.
Subject to clause 15.1, our total liability to you in connection with the Service in any twelve month period is limited to the greater of the total amount you paid us in that period and ₦10,000.
You acknowledge that the Service is provided free or at a low price precisely because our liability is limited in this way, and that this allocation of risk is reasonable.
16.Your liability to us
You shall indemnify us against any claim, loss, or cost we suffer arising from your breach of these terms, from any content you submit, or from your use of the Service to harm another person.
17.General
If any provision of these terms is held to be invalid or unenforceable, the rest continue in force.
Our failure to enforce a provision is not a waiver of that provision.
We may transfer our rights and obligations under these terms to another company, including to a parent or holding company, without affecting your rights.
These terms are the entire agreement between you and us in respect of the Service.
18.Complaints, law, and disputes
If you have a complaint, contact us first at the address in clause 19. We acknowledge a complaint within five working days and respond substantively within thirty days.
These terms are governed by the laws of the Federal Republic of Nigeria.
The courts of Nigeria have jurisdiction over any dispute arising out of these terms. Nothing in this clause affects any right you have to bring a complaint to the Federal Competition and Consumer Protection Commission or to the Nigeria Data Protection Commission.
